Terms of Use

1. Agreement

These Terms of Use (“Terms”) are an agreement between you and Alexandra's Arc LLC, a South Carolina limited liability company (“we,” “us,” or “our”), which operates The Social Pet Club app and website (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.

2. Who can use the Service

You must be at least 13 years old (or older if your local law requires) to use the Service. If you are under 18, you must have permission from a parent or guardian. We sign you in with a one-time link sent to your email, so you agree to give accurate account information, keep your email account secure, and tell us right away about any unauthorized use of your account. You are responsible for activity on your account.

3. Community rules

The Social Pet Club is for pets and the people who love them. We have zero tolerance for objectionable content or abusive members. You agree not to post or do anything that:

• Shows, promotes, or makes light of animal cruelty, neglect, abuse, or illegal animal fighting.
• Offers animals for sale or trade, or promotes illegal wildlife trade or puppy and kitten mills. Exception: rescue organizations we have approved may list animals for adoption and may charge adoption fees under their own adoption policies. Breeders, resellers, and anyone selling animals may not list animals on the Service.
• Harasses, bullies, threatens, or targets anyone, including with hate based on race, ethnicity, religion, disability, sex, gender identity, sexual orientation, or other protected traits.
• Is sexually explicit, graphically violent, or otherwise obscene.
• Shares someone else's private information without permission.
• Infringes someone else's copyright, trademark, privacy, or other rights. Post photos and videos you took or have permission to use.
• Is spam, a scam, misleading, or impersonates another person, pet, or organization.
• Breaks the law, or encourages others to.
• Tries to hack, scrape, overload, or interfere with the Service, or to access accounts or data that aren't yours.

Keep it about the animals. People are welcome in the frame, but pets are the stars.

4. Your content

You own the photos, videos, captions, comments, and other content you post (“Your Content”). You are responsible for Your Content and confirm that you have the rights needed to post it, including permission from anyone recognizable in it.

5. License you give us

So we can run the Service, you grant Alexandra's Arc LLC a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, use, display, reproduce, modify (for example, to resize or format), and distribute Your Content in connection with operating, improving, and promoting the Service. This license ends when you delete Your Content or your account, except where Your Content has been shared with others who haven't deleted it, where we must keep it for legal reasons, or for backup copies that are deleted on our normal cycle. If we'd like to feature your post in advertising outside the App, we'll ask you first.

6. Reporting and moderation

To report content or a member, use Report in the App where it is available, or email alex@thesocialpetclub.com with the member's username and a screenshot or description. If another member is bothering you, email us and we will step in. We review reports promptly. Our goal is to act on objectionable content within 24 hours by removing it and, where appropriate, removing the member who posted it. More reporting tools and the ability to block members are coming to the App. We may remove any content or suspend or terminate any account at our discretion if we believe it violates these Terms or puts people or animals at risk. We are not obligated to monitor all content and are not responsible for content posted by members.

7. Our content and brand

The Service, including its design, software, logos, and the name “The Social Pet Club,” belongs to Alexandra's Arc LLC and is protected by law. We give you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on your devices for personal, non-commercial use under these Terms. Please don't copy, modify, or reverse engineer the App, or use our name or logo without written permission. The Social Pet Club™ is a trademark of Alexandra's Arc LLC.

8. App stores

If you download the App from the Apple App Store or Google Play, you also agree to that store's terms. Apple and Google are not parties to these Terms and are not responsible for the App or its support. For apps downloaded from the Apple App Store, Apple's Licensed Application End User License Agreement also applies to the extent these Terms don't address something, and Apple is a third-party beneficiary of these Terms with the right to enforce them against you.

9. Ending your account

You can stop using the Service at any time. To delete your account and data, email alex@thesocialpetclub.com from your account email; we'll complete the deletion within 30 days, as described in our Privacy Policy. A Delete account option inside the App is coming. We may suspend or end your access if you break these Terms or if we stop offering the Service. Sections that by their nature should survive (such as ownership, disclaimers, limitation of liability, and disputes) survive termination.

10. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. Content on the Service, including pet care tips shared by members, is not veterinary advice. Always talk to a licensed veterinarian about your animal's health. Meeting other members or their pets in person is at your own risk; please use good judgment.

11. Limitation of liability

To the fullest extent permitted by law, Alexandra's Arc LLC and its members, managers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of the Service. Our total liability for any claim related to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or US $100. Some places don't allow certain limits, so some of these may not apply to you.

12. Indemnity

You agree to defend and hold harmless Alexandra's Arc LLC from claims, damages, and costs (including reasonable attorneys' fees) arising from Your Content or your violation of these Terms or the law.

13. Governing law

These Terms are governed by the laws of the State of South Carolina, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Charleston County, South Carolina, and you and we consent to their jurisdiction, unless applicable law requires otherwise. Before filing any claim, please email us so we can try to sort it out informally.

14. Changes

We may update these Terms. If changes are material, we'll let you know in the App or by email before they take effect. Using the Service after that means you accept the updated Terms.
